Private ordering in the Czech transformation process
Article Abstract:
The Czech Republic has sought to make its legislation similar to that of the European Union at a time when the legal system was unprepared for such a big change. Private ordering includes fair trade and free enterprise. The legacy of the past means that there is an unwillingness to deal with gaps in the law.

Private ordering includes informal regulations supplementing the legal system, but the Czech legalsystem is not well established. The Czech judicial system has tended to be sluggish and change has been gradual.

The legal preconditions for setting up a western-style system of private law have not been evident in the Czech Republic. There are opportunities for finding new sets of rules when systems are not developed.
